Q : My credit is bad, am I wasting my time?
A : No. Almost everyone who has fallen behind on house payments have had some credit problems in the past. We help people regardless of credit.
Q : Why did my mortgage company send me my payment back?
A : After your mortgage company accelerates your loan, they no longer accept a payment less than the full amount due. They are likely to send it back to you, asking for the whole amount. The reason for this has its origin in case law.
Q: What do I do if someone stops by the house?
A: It is possible that investors or bank representatives will come by and look at your house. This is their way of evaluating the condition of the collateral on your mortgage. The bank may be checking that it is not vacant.
Q: How much time do I have?
A: It depends on which state your property is in. In Cook county Illinois, the courts are behind by up to 20 months. In a case like this, you could actually stay in your home without making payments for a very long time. Other states, like Texas for instance, will schedule your home for foreclosure sale just 3 weeks after serving you with notice. Time is no friend when you're behind. Take steps to get yourself caught up. The longer you wait, the more you pay in court costs, late charges, and attorney fees.
Q: Can United Mortgage Co. help with my other bills?
A: Possibly. This will depend on your Loan-to-Value Ratio (LTV) . . . how much you owe verses how much the home is worth.
Q: I've received papers from the court. Do I have to attend on the
hearing day?
A: You have the right to appear, but are not compelled to do so. The purpose of a hearing is for the mortgage representative to validate the debt. They show the judge that the loan made to you was a legal one, and that the foreclosure sale should be scheduled the next month. These hearings are a swift formality done by rubber stamp. If you feel the mortgage company has not properly posted your payments, or is wrongfully foreclosing, you have the right to explain your position. If not, then your time is probably better spent at work earning a living.

Q. Do I need to have a special type of mortgage loan for UMC to help me?
A. No. Whether you have an FHA, VA, State, or Conventional type loan, UMC has been able to assist clients in saving their homes and getting them caught up and back on track with their mortgage payments with any one of these types of mortgage loans.
Q. Can UMC help me even after my mortgage lender's attorneys are involved?
A. In most cases, YES. UMC has helped hundreds of clients to resolve their mortgage difficulties and them get back on track with their mortgages, even after the mortgage lender's attorneys have become involved (this of course is contingent upon how far in the foreclosure process you currently are).
Q. My lender told me I must pay them all the money I am behind or they will do nothing for me. Can UMC still help me?
A. United Mortgage Co. can still help you. Our loan programs are based on LTV (Loan-to-Value Ratio), not credit, credit score, or how behind your payments are when you contact us.
Q. What about Bankruptcy?
A. Think Twice!
Why was it invented?
Since its inception, the bankruptcy code was designed for one
purpose: To help relieve Americans from the shackles of
endless and unmanageable debts. Before the bankruptcy code
came about, people went to debtor's prison. We all know we
can't pay many bills while in jail. So the law was written to give
people a way out with a fresh start.
The Price you pay.
Aside from the attorney fees of up to $1500.00, and
appearances in court, bankruptcy is not a pleasant experience.
The filing becomes a matter of public record and the mark stays
on your credit file for 10 years. The mark proclaims to the world,"I had to rely on the court's protection from my creditors. I was
unable or unwilling to find another solution." This is why lenders
are concerned when they see this notation. It makes borrowing
in the future a bigger challenge and rates are higher for as long as
they hold it against you.
When bankruptcy makes sense.
When you have exhausted every avenue possible, and you
simply cannot make your payments, it may be time to consider
the protection from the court. The filing of a bankruptcy will stop
a foreclosure in its tracks. The mortgage company must cease all
collection and legal activity by law. In a chapter 13, a trustee is
appointed who will disburse funds from your pay to go to all of
your creditors in a plan that you can afford. You will pay your
mortgage payment each month as you did before you ran into
trouble, with no increase to the payment. The pay plan will
continue for 3 to 5 years depending on the amounts behind.
